the Absentee-Shawnee Tribe of Indians of Oklahoma has a Constitution approved by the Department of the Interior, last amended in August, 1988, and |
WHEREAS, |
the Executive Committee of the Absentee-Shawnee Tribe of Indians of Oklahoma is empowered by the Constitution to speak and otherwise conduct business in the name of, and on behalf of, the Absentee Shawnee Tribe of Indians of Oklahoma, and |
WHEREAS, |
it is the duty and responsibility of the Executive Committee to amend the laws and ordinances of the Tribe from time to time in the best interests of the Tribe and its membership, and |
WHEREAS, |
it is deemed in the best interests of the Absentee Shawnee Tribe and its membership that Sections 2, 3, and 5 of the Police and Law Enforcement Services portion of the Absentee Shawnee Code of Laws as shown below, shall be repealed in their entirety: Section 2. Executive Committee in Command The Executive Committee shall be recognized as Commanders of the Absentee Shawnee Tribal Police Department. The Executive Committee shall keep informed as to the efficiency and conduct of the Tribal Police in the discharge of their duties. Section 3. Chain of Command The administrative matters such as the purchase of supplies and equipment, personnel actions, budgeting requirements, and similar matters, the Chief of the Tribal Police Department shall report the affairs of the Department to the Executive Committee. In police matters such as incident reports, scheduling of duty officers, police efficiency, reports on prisoners in custody, and similar matters, the Chief of the Tribal Police Department shall report the affairs directly to the Executive Committee. The Chief of Police shall report the administrative affairs of the Department directly to the Executive Committee at least once each month. Section 4. Chief of Tribal Police Department The Executive Committee shall appoint a person to be the Chief of the Tribal Police Department. Section 5. Duties of the Chief of the Tribal Police Department It shall be the duty of the Chief of the Tribal Police Department to: (a) Obey the lawful orders of the Executive Committee, (b) See that the orders of the Tribal Court are properly carried out, to detail such police officers as may be necessary to carry out the orders of the Tribal Court, and to act as bailiff or preserve order during sessions of the Court, (c) Keep informed as to the efficiency and conduct of the Tribal Police in the discharge of their duties, and be responsible to the Executive Committee for the conduct and efficiency of the Officers and employees of the Department, giving them such instruction and advice as may be necessary, (d) Subject the Officers and employees of the Department to regular inspection, inform them of their duties, and keep a strict accounting of the equipment issued them in connection with their official duties, (e) Report to the Executive Committee all violations of law or regulation and any misconduct of any member of the Tribal Police Department, investigate all reports and charges of misconduct on the part of Officers and employees of the Department, and exercise such proper disciplinary measures as may be consistent with existing tribal personnel policies and police regulations, and (f) To have general charge over the affairs and activities of the Department and to supervise all Departmental personnel of lesser rank. and, |
WHEREAS, |
the following new Sections 2, 3, and 5 shall be effective immediately upon adoption of this Resolution: Section 2. Command (a) The Executive Committee as a whole shall be recognized as having the ultimate authority over the Absentee Shawnee Tribal Police Department. The Executive Committee shall keep informed as to the efficiency and conduct of the Tribal Police in the discharge of their duties. (b) It being the duty of the Governor to have general supervision of the affairs of the Police Department subject to the ultimate direction of the Executive Committee, and to perform all duties appertaining to the office of the Governor, which duty includes the duty to see that the laws of the Absentee Shawnee Tribe are enforced, the Governor shall be recognized as the commander of the Absentee Shawnee Tribal Police Department. The Governor shall keep informed as to the efficiency and conduct of the Tribal Police in the discharge of their duties. Section 3. Chain of Command In administrative matters such as the purchase of supplies and equipment, personnel actions, budgeting requirements, and similar matters, the Chief of the Tribal Police Department shall make all official reports of the affairs of the Department to the Governor,who shall submit such reports to the Executive Committee. In police matters such as incident reports, scheduling of duty officers, police efficiency reports, reports on prisoners in custody, reports of civil rights violations and police misconduct and similar matters, the Chief of the Tribal Police Department shall report the affairs of the Department directly to the governor. The governor shall report the affairs of the Department directly to the Executive Committee at least once each month. Section 4. Chief of Tribal Police Department The Executive Committee shall appoint a person to be the Chief of the Tribal Police Department. Section 5. Duties of the Chief of the Tribal Police Department It shall be the duty of the Chief of the Tribal Police Department to: (a) Seek and follow direction of the Executive Committee on broad policy questions. (b) Seek and follow direction of the Governor in cases of emergency and/or issues not addressed by tribal law, policy or directive of the Executive Committee. (c) See that the orders of the Tribal Court are properly carried out, to detail such police officers as may be necessary to carry out the orders of the Tribal Court and to act as bailiff or preserve order during the sessions of the Court. (d) Keep informed as to the efficiency and conduct of the Tribal Police in the discharge of their duties, and be responsible to the Governor for the conduct and efficiency of the Officers and employees of the Department, giving them such instruction and advice as may be necessary, (e) Subject the Officers and employees of the department to regular inspection, inform them of their duties, and keep a strict accounting of the equipment issued them in connection with their official duties, (f) Report to the Governor all violations of law or regulation and any misconduct of any member of the Tribal Police Department, investigate all reports and charges of misconduct on the part of the officers and employees of the department, and exercise such proper disciplinary measures as may be consistent with existing tribal personnel policies and police regulations. (g) To have general charge over the affairs and activities of the Department and to supervise all Departmental personnel of lesser rank. |

should the contents of this Resolution be found to be in conflict with any other provision of the Police and Law Enforcement Services portion of the Absentee Shawnee Code of Laws, then the language of this Resolution shall take precedence. |

When any question arises as to whether a particular police matter should be reported through the Tribal Administrator or directly to the Governor, the determination of the Governor on such question shall be final. Section 4. Chief of Tribal Police Department The Governor, with the advice and consent of the Executive Committee expressed by resolution, shall appoint a person to be the Chief of the Tribal Police Department. Section 5. it is the purpose and intent of this amendment to the Absentee Shawnee Code of Laws to place the Office of the Chief of Tribal Police and the Tribal Police Department under the supervision and direction of the Executive Committee of the Absentee Shawnee Tribe, and |

should the contents of this Resolution be found to be in conflict with any other provision of the Police and Law Enforcement Services portion of the Absentee Shawnee Code of Laws, then the language of this Resolution shall take precedence. |

Section 604, Bonding, of Chapter Six of the Police and~ Law Enforcement Services, Absentee Shawnee Code of Laws, currently reads as follows: "The Chief of Police by regulation shall provide for the bonding of all Police Officers in the enforcement division, and such other officers as may be bonded in an amount determined by the Chief of Police with the consent of the Executive Committee. The cost of such bonds shall be paid from tribal funds. The sovereign immunity of the Tribe is hereby waived in the Tribal Court only, and only to the extent and scope of the coverage of such bonds as may be in force at any particular time, as to actions by persons injured due to excessive use of force, violation of civil rights, or other cause inflicted by Tribal Police Department personnel. This section shall not be construed to provide any independent cause of action against either the Tribe or their Police Officers." |

Section 604, shall hereafter be entitled Professional Liability, and shall read as follows: "The Chief of Police, by regulation, shall obtain Police Professional Liability Insurance to cover all Tribal Law Enforcement Officers. This section shall not be construed to provide any independent cause of action against any Tribal Law Enforcement Officer". |
