Resolution No. 064-92
WHEREAS, the Grand Ronde Tribal Council, pursuant to Article III, Section I of the Tribal Constitution approved November 30, 1984 by the Acting Deputy Assistant Secretary on Indian Affairs, is em powered to exercise all legislative and executive authority not specifically vested in the General Council of the Confederated Tribes of the Grand Ronde Community of Oregon; and,
WHEREAS, by Public Law 100-425, the United States has returned 9,811 acres of timberland to the Confederated Tribes of the Grand Ronde Community of Oregon for the primary use as a timber producing forest; and
WHEREAS, the Tribe has agreed to manage the Reservation timberlands on a sustained yield basis according to sound forest management principles; and
WHEREAS, the Tribal Council has appointed a Timber Committee to provide advice and recommendations to the Tribal Council regarding issues affecting the management of and acquisition of the Tribe's Reservation and the management of timber lands; and
WHEREAS, the Tribal Council and the Timber Committee have developed a Timber Committee Ordinance to specifically define the purpose and authority of the Timber Committee; and
WHEREAS, the Tribal Council has reviewed the Timber Committee Ordinance and has made necessary adjustments,
NOW THEREFORE BE IT RESOLVED, that the Tribal Council hereby adopts the Tribal Timber Committee Ordinance.
CERTIFICATION: The Tribal Council for the Confederated Tribes of the Grand Ronde Community of Oregon passed this Resolution at a regularly scheduled meeting with a quorum present as required by the Grand Ronde Tribal Constitution held December 2, 1992, by a vote of 6 yes, 0 no, and 0 abstentions.

TIMBER COMMITTEE ORDINANCE
TRIBAL CODE § 6.10
(a) PURPOSE AND AUTHORITY: The purpose of this ordinance is to establish a Tribal Timber Committee and the rules governing the Committee.
The authority to establish the Timber Committee is found in the Tribal Constitution, article III, section 1; and the General Committee Ordinance adopted by Resolution No. 261-88.
(b) DEFINITIONS:
- (1) "Timber Committee" means the Timber Committee of the Confederated Tribes of the Grand Ronde Community of Oregon, established pursuant to this ordinance.
- (2) "Tribe" means The Confederated Tribes of the Grand Ronde Community of Oregon.
- (3) "Tribal Council" means the Tribal Council of The Confederated Tribes of the Grand Ronde Community of Oregon.
- (4) "Reservation" means the Reservation established for The Confederated Tribes of the Grand Ronde Community of Oregon.
- (5) "Tribal Forester" means the Tribal Forester for The Confederated Tribes of the Grand Ronde Community of Oregon.
- (6) "Immediate Family" means brother, sister, father, mother, son, daughter or member of household.
- (7) "Forest Practices Ordinance" means the Forest Practices Ordinance enacted by the Tribal Council of The Confederated Tribes of the Grand Ronde Community of Oregon.
(c) ELECTION OF OFFICERS: The Timber Committee shall elect a chairperson, a vice—chair, and a secretary/treasurer. The election shall take place at the annual meeting. Officers shall serve for terms of one year.
(d) DUTIES:
- (1) It shall be the duty of the Timber Committee to assist the Tribal Council to provide quality services to the Tribal membership and to develop, maintain, and protect the Tribe's interests and assets involving the timber resource on the Reservation.
- (2) The Timber Committee shall act in an advisory capacity to the Tribal Council in recommending policies and procedures, identifying needs, and developing priorities concerning the timber resource and related assets on the Reservation.
- (3) The Timber Committee shall report monthly to the Tribal Council on problems, activities and other relevant information.
- (4) The Timber Committee shall report quarterly to the General Council on its activities.
- (5) The Timber Committee shall advise the Tribal Forester on matters of policy affecting the Reservation.
- (6) The Tribal Forester shall keep the Timber Committee informed and current on forestry activities occuring on the Reservation.
(e) MEETINGS:
- (1) The Timber Committee shall have regular meetings monthly and special meetings as necessary to conduct business. The dates of the meetings shall be set by the Committee.
- (2) Special meetings of the Timber Committee may be called when business must be done prior to the next regular meeting. Said special meetings may only be called by the Chairperson or the Vice—Chairperson, and reasonable, timely notice must be given to all committee members.
(f) VOTING:
- (1) Each member of the Timber Committee shall have one vote on each matter brought before the members. Members must be present to vote. No proxies will be permitted.
- (2) A majority of the Timber Committee members must be present to constitute a quorum.
(g) CONFLICTS OF INTEREST:
- (1) A member of the Timber Committee may not vote on any action directly involving him or herself or a member of his or her immediate family. A committee member may take part in discussion and count toward a quorum regarding action involv ing him or herself or a member of his or her immediate family.
(h) FOREST PRACTICE ORDINANCES:
- (1) The Timber Committee shall abide by the Forest Practices Ordinance, the Minor Forest Practices Ordinance and other Tribal Ordinances related to reservation management. The Tribal Forester shall administer the Forest Practices Ordinances and shall report any violations to the Timber Committee.
(i) DUTIES OF OFFICERS:
- (1) The Chairperson shall issue notice of Committee meetings, preside at all committee meetings, and act as representative of the committee in communications with individuals, groups, and organizations.
- (2) The Vice-Chair shall act as presiding officer in the Chairperson' s absence.
- (3) The Secretary/Treasurer shall:
- A. Keep minutes of all regular and special meetings,
- B. Maintain all official records of the committee,
- C. Take attendance at meetings, and
- D. Answer all correspondence for the committee.
