Resolution No. 308-88
WHEREAS, The Grand Ronde Tribal Council pursuant to Article III, Section I, of the Tribal Constitution approved November 30, 1984, by the Acting Deputy Assistant Secretary of Indian Affairs, is empowered to exercise all Tribal legislative and executive authority not specifically vested in the General Council of the Confederated Tribes of the Grand Ronde Community of Oregon; and,
WHEREAS, the Confederated Tribes of Grand Ronde Tribal Council is strongly committed to providing a positive educational future for Tribal members; and
WHEREAS, the Tribal Council finds it necessary to establish a Tribal Education Committee to assist the Council in meeting this task;
NOW THEREFORE BE IT RESOLVED, the Confederated Tribes of Grand Ronde Tribal Council, pursuant to Article III, Section I, of the Constitution, hereby adopt the Grand Ronde Tribal Education Committee Ordinance.
Certification: The Tribal Council of the Confederated Tribes of the Grand Ronde Community of Oregon passed the forth going resolution at a meeting held on November 14, 1988 , by a vote 7 yes, 0 no, and 0 abstain.

EDUCATION COMMITTEE ORDINANCE
TRIBAL CODE § 8.50
(a) PURPOSE AND AUTHORITY: The purpose of this ordinance is to guide the Tribal Education Committee in advising the Tribal Council and the Tribal Education Program on education services. Authority for this ordinance is Article III, Section I, of the Constitution of the Confederated Tribes of the Grand Ronde Community of Oregon.
(b) DEFINITIONS:
- (1) "Council" means the Tribal Council of the Confederated Tribes of the Grand Ronde Community of Oregon.
- (2) "Committee" means the Confederated Tribes of the Grand Ronde Community of Oregon Education Committee.
- (3) "Director" means the head of the education department of the Confederated Tribes of the Grand Ronde Community of Oregon.
- (4) "Tribe" means the Confederated Tribes of the Grand Ronde Community of Oregon.
(c) DUTIES OF THE COMMITTEE: The Education Committee will carry out the following duties to insure quality educational services are provided to Tribal members:
- (1) Advise the Tribal Council in identifying needs, and developing educational priorities, policies and procedures for the Tribe;
- (2) assist the Council in researching all available educational scholarships, grants, and funding sources;
- (3) identify and recommend educational goals and objectives that would enhance the education of tribal members and the planning for their education needs;
- (4) monitor state & federal legislation affecting Indian Education;
- (5) recommend education conferences, seminars, and workshops to provide educational enhancement of tribal members;
- (6) conduct an annual review of educational program activities for possible recommended revision and changes;
- (7) work with Education Program Staff & the Council in drafting education policy and procedure manuals consistent with tribal priorities & federal requirements;
- (8) conduct hearings on formal education appeals, grievances, and complaints filed by applicants/recipients;
- (9) undertake other education-related duties & responsibilities as delegated by the Council; and
- (10) conduct its business according to the Tribe's Committee Ordinance.
(d) QUALIFICATIONS OF MEMBERS: Committee members must be members of the Tribe who are 18 years of age or older. In selecting members of the committee, the Tribe shall give preference to persons who:
- (1) are committed to improved educational opportunities for tribal members,
- (2) are able to travel & attend education meetings if necessary, and
- (3) are able to communicate in writing & orally.
(e) APPEALS:
- (1) Recipients/applicants who are aggrieved by a decision of the Director may appeal the decision to the Committee within fifteen (15) days of receiving notice of it. The Committee will notify the appellant and the Director of the time for hearing at least seven days prior to the hearing. The Committee shall use informal procedures when hearing appeals. The appellant and the Education Director have the right to testify and to present relevant evidence at the hearing. The Committee shall decide the appeal within thirty (30) days of receiving the appeal. The Committee shall put its findings regarding the alleged violation i writing with supporting reasons.
- (2) Recipients/applicants who are aggrieved by a decision of the Committee under section 3(8) may appeal the decision to the Tribal Council provided, however, that the Tribal Court shall handle such appeals once the Tribal Court empowers it to do so. The appeal must be in writing with supporting reasons and made within fourteen (14) days of the Committee's action. The appeal must be based on the record of the Committee meeting at which the initial appeal was considered. The Tribal Council will notify the appellant and the Education Director of the time for hearing at least seven days prior to the hearing. Both the appellant and the Education Director have the right to testify and to present relevant evidence at the hearing. The decision of the Tribal Council shall be final.
