Resolution No. 262-88


WHEREAS, the Grand Ronde Tribal Council, pursuant to Article III, Section I, of the Grand Ronde Constitution approved November 30, 1984 by the Acting Deputy Assistant Secretary of Indian Affairs, is empowered to exercise all legislative and executive authority not specifically vested in the General Council of the Confederated Tribes of the Grand Ronde Community of Oregon; and,

WHEREAS, the Tribal Council of the Confederated Tribes of the Grand Ronde Community of Oregon has appointed a Health Committee to provide advise and recommendations to the Tribal Council regarding issues affecting the health care of tribal members; and,

WHEREAS, the Tribal Council has developed a Health Committee Ordinance to specifically define the purpose and authority of the Health Committee; and,

WHEREAS, the Tribal Council has reviewed the Health Committee Ordinance and have made necessary adjustments.

NOW THEREFORE BE IT RESOLVED that the Tribal Council hereby adopts the Tribal Health Committee Ordinance.

CERTIFICATION: the Tribal Council of the Confederated Tribes of the Grand Ronde Community of Oregon passed the forth going resolution at a regularly scheduled meeting held on January 15, 1988 by a vote of 6 yes, 0 no, 0 abstain.

TRIBAL CODE § 8.10

(a) PURPOSE AND AUTHORITY: The purpose of this ordinance is to guide the Tribal Health and Human Services Committee in advising the Tribal Council and the Tribal Health, Social Services, Indian Child Welfare and Alcohol and Drug Programs and in representing the Tribe. Authority for this ordinance is Article III, Section I, of the Constitution of the Confederated Tribes of the Grand Ronde Community of Oregon.

(b) DEFINITIONS:

(1) "Council" means the Tribal Council of the Confederated Tribes of the Grand Ronde Community of Oregon.
(2) "Committee" means the Confederated Tribes of the Grand Ronde Community of Oregon Health and Human Services Committee.
(3) "Tribe" means the Confederated Tribes of the Grand Ronde Community of Oregon.
(4) Human Services Manager means the Manager of the Human Services Division of the Confederated Tribes of the Grand Ronde Community of Oregon.
(5) "Officer" means the Chairman, Vice-Chairman, and Secretary of the Confederated Tribes of the Grand Ronde Community of Oregon Health and Human Services Committee.
(6) "Coordinator" means the Counseling Component Coordinator within the Human Services Division of the Confederated Tribes of the Grand Ronde Community of Oregon.

(c) MEMBERSHIP OF THE COMMITTEE:

(1) The Committee shall consist of eight (8) voting members.
(2) Four (4) voting members shall constitute a quorum, provided that at least two Officers are present.
(3) Any Officer may speak for the Committee at the direction of the Committee.
(4) The following non-tribal members will be advisory, non-voting members of the Committee:
(A) The designated representative of the I.H.S.; and,
(B) The Portland Area Director of the B.I.A. Siletz Agency, or his or her designated representative.

(d) DUTIES OF THE COMMITTEE:

(1) Advise the Tribal Council in identifying needs and developing priorities, policies and objectives of the Tribal Health, Family Action Program, Prevention and Treatment Programs; so as to promote self-sufficiency.
(2) Advise the Tribal Health, Family Action Program, Prevention and Treatment Programs in developing long range program plans;
(3) Inform the Tribe of Indian Health Service policy and procedures;
(4) Represent the interests and desires of the Tribe;
(5) Maintain membership on the Northwest Portland Area Indian Health Board; the Human Services Manager, if available, shall represent the interests of the Committee on the Northwest Portland Area Indian Health Board, and shall report back to the Committee concerning meetings of said Board. If the Human Services Manager is unavailable, the Chair shall designate an alternate to represent its interests on said Board;
(6) Maintain membership on the Western Oregon Services Unit; the Human Services Manager, if available, shall represent the interests of the Committee on the Western Oregon Services Unit, and shall report back to the Chair concerning the meetings of the Service Unit. If the Human Services Manager is unavailable, the Committee shall designate an alternate to represent its interests on the Western Oregon Service Unit;
(7) Maintain membership on the National Indian Child Welfare Institute; the Coordinator, if available, shall represent the interests of the Committee on the Northwest Indian Child Welfare Institute, and shall report back to the Committee concerning the meetings of said Institute. If the Coordinator is unavailable, the Chair shall designate an alternate to represent its interests on said Institute;
(8) Promote health and the prevention of disease, promote self-sufficiency and its benefits, promote strong families, and promote treatment and prevention of alcohol and drug abuse and other dysfunctions among tribal members and their families;
(9) Develop a policy for the Administration of the Health Endowment Fund to cover tribal members and their families for the cost of "deferred services," as defined by tribal policy;
(10) Inform the Tribal Council of the meeting agendas of the various boards and institutes that the Committee maintains membership on prior to those meetings; and
(11) Conduct its business according to the Tribe's General Committee Ordinance.
