CHAPTER 8 - - HUNTING REGULATIONS

8.1 SECTION 1: DEFINITIONS

8.1.1

SMALL GAME: Rabbit, squirrel, ruffed grouse, sharp tail grouse, spruce grouse, pheasant and birds regulated by federal law as Migratory Water Fowl in Title 50, CFR 10.

8.1.2

BIG GAME: Deer, Bear.

8.1.3

FUR BEARING ANIMALS: Beaver, mink, muskrat, otter, skunk, raccoon, fox, weasel, opossum, coyote, squirrel, wild cat, and lynx.

8.1.4

MIGRATORY GAME BIRDS: Ducks, geese, brant, rails, coots, gallinule, woodcock, and Wilsons snipe (jacksnipe) .


8.2 SECTION 2: LICENSES AND PERMITS

No member shall hunt on the Reservation until s/he has attained the age of 14 years unless accompanied by a parent or guardian.

8.2.2

Members of the Red Cliff Tribe do not need hunting licenses but must possess a Tribal I.D. card and abide by all laws and hunting regulations of the Red Cliff Band.

8.2.3

Non-members are required to obtain from the Tribal Law Enforcement Office, and have in their possession while hunting, a Red Cliff Tribal Hunting License, which license is subject to the limitations and regulations of this Chapter 8. The fee for a small game license shall be $15.00, the fee for a big game license shall be $30.00.

8.2.4

Persons interested in obtaining permits for controlling animals causing damage, scientific collection, disabled person hunting, wildlife exhibit, game farms, fur animal farms or deer farms must inquire with the Red Cliff Law Enforcement Office.


8.3 SECTION 3: ARMS AND AMMUNITION RESTRICTIONS

It is unlawful to:

8.3.1

Hunt with any means other than the use of a gun discharged from the shoulder or a bow and arrow. However, .22 caliber rimfire handguns and pellet guns of .177 caliber or larger may be used for the same purposes as .22 caliber, rimfire rifles.

8.3.2

Be in possession of handguns (any gun having a barrel less than 12 inches in length) if under the age of 18 years unless supervised by an adult L8 years of age or older .

8.3.3

Hunt deer with the aid of a dog, or train dogs by pursuing deer. Bear can be hunted with the aid of cogs only by special permit from the tribal council and provided that permittees comply with Wiscoinsin Statutory restrictions governing the size of dog packs and the duration of the season for hunting bear with dogs. In any event, the season for hunting bear with dogs shall commence no sooner than the fifteenth (15th) of September. and shall extend no longer than the first Friday in October; neither shall dog packs exceed six (6) in number.

8.3.4

Carry or place in or on any vehicle, moving or standing, any firearm, unless such firearm is unloaded.

8.3.5

Use arrows for hunting deer or bear that are not well sharpened broadhead blades. Broadhead blades may not be less than seven-eighths of an inch or more than one and one half inches in width.

8.3.6

Hunt deer or bear with a bow having a pull of less than 30 pounds.


8.4 SECTION 4: HUNTING METHOD RESTRICTIONS

It is unlawful to:

8.4.1

Discharge a firearm on lands of another within 100 yards of a building devoted to human occupancy without permission of the owner or occupant.

8.4.2

Appropriate, molest, or disturb any wild animal or the carcass or part thereof which has been lawfully reduced to possession by another without having that persons consent .

8.4.3

Put out bait containing poison where it might cause the destruction of wild animals or birds or possess poison while hunting or trapping.

8.4.4

Posses any carcass of a deer or bear taken by means other than with a gun or a bow and arrow unless permission is obtained from the Red Cliff Law Enforcement Off ice.

8.4.5

Any illegally taken or posessed game bird or animal or the carcass or part thereof may be confiscated by the Red Cliff Law Enforcement and used for the Elderly or other Tribal purposes.


8.5 SECTION 5: REGISTRATION

8.5.1

You must register deer and bear killed no later than 5:00 p.m of the third day a fter it was killed.

8.5.2

All deer and bear are to be registered with the Red Cliff Law Enforcement.


8.6 SECTION 6: PROTECTED SPECIES

Animals and birds protected at all times:

8.6.1

Marten, fisher. wolverine, badger. flying squirrel, Canada lynx, white deer, and timber wolf.

8.6.2

Prarie Chicken, Canada spruce grouse (spruce hen), mourning dove, swan, crane, kingfisher, cormorant, great blue heron, bitterns, plovers, sandpipers, loons. all species of grebes (helldivers), and all endangered species listed in the current edition of Rare and Endangered Fish and Wildlife of this U.S.

8.6.3

All eagles, hawks, falcons, and owls.

8.6.4

All other wild birds including song birds not specified herein .


8.7 SECTION 7: ANIMALS AND BIRDS CAUSING DAMAGE

8.7.1

Crows.grackles, red-winged blackbirds, and cowbirds may be taken at any time without permit when causing damage or about to cause damage to trees, crops, livestock or wildlife or when concentrated in large numbers that may constitute a nuisance.


8.8 SECTION 8: UNPROTECTED ANIMALS AND BIRDS

8.8.1

Coyotes, opossum, all skunks. weasels, starling, english sparrow, chukar partridge and cotunix quail.

8.8.2

Any person who violates any section of 8.8 shall forfeit not more than $5000 ($50.00 deposit permitted).


8.9 SECTION 9: HUNTING SEASON

8.9.1

DEFINITIONS

a: Legal Buck: one male deer.

b: Either Sex: one deer, either sex, any age. c: Dates: first and last day of season.

8.9.2

BIG GAME HUNTING SEASON

8.9.3

Upon request made to the Red Cliff Conservation Commission or Red Cliff Conservation Department to take deer or bear in excess of the above season limit, the Commission or Department may grant a special permit to kill deer or bear in excess of the season limit of one deer or one bear per hunter.

8.9.4

8.10 SECTION 10: PROTECTION OF ENVIRONMENT

8.10.1

In carrying on hunting or trapping activities, no one shall cause damage to the natural habitat, other than is normally incidental to the reasonable and careful exercise of the activity.

8.10.2

Anyone who violates 8.10.1 shall forfeit not more than $250 ($25.00 deposit permitted) .


8.11 SECTION 11: ENDANGERING HUMAN LIFE

8.11.1

In carrying on hunting or trapping activities, every individual shall take extreme care to avoid endangering human life or causing physical injury to other persons.

8.11.2

Any Person who fails to comply with 8.11.1 shall forfeit not more than $5000 ($50.00 deposit permitted) .

8.11.3

ENFORCEMENT: Any person who violates any section of this Chapter 8 except where otherwise provided shall forfeit not more than $150 ($25.00 deposit permitted).
