CHAPTER 24 - - FISH MARKETING

24.1 SECTION 1: REQUIREMENS

24.1.1

Any tribal member engaged in buying treaty-caught fish or receiving such fish on consignment for the purpose of resale shall have a Fish Dealers License issued by the Red Cliff Band, and, for the purposes of this section. shall be termed a Fish Dealer. There shall be no charge for the license. The license shall expire on December 31 of each year unless renewed.

24.1.2

Storage, processing, and transportation facilities utilized by a Fish Dealer shall be kept suffiently clean and free of vermin to ensure that the products offered for sale are wholesale and of high quality.

24.1.3

As a condition of receiving a Fish Dealers License, a Fish Dealer consents to allow tribal law enforcement personnel to inspect the premises, storage facilities. and vehicles used in fish marketing at any reasonable time and place. Such inspection may be held for the purpose of detecting violations of fish marketing regulations (this Chacter) or of Commercial Fishing Regulations (Chapter 7).

24.1.4

All fish required to be tagged under the Regulations (Chapter 7) shall bear proper tags while in the possession of a Fish Dealer.


24.2 SECTION 2: PENALTIES

24.2.1

Possession by a Fish Dealer of fish not properly tasgged shall subject both the Fish Dealer and the Commercial Fishing Licensee from whom the Fish Dealer received the fish to a Tribal Court forfieture not to exceed $5,000.00.

24.2.2

Aggravated or repeated violations of this Chaster shall be grounds for revocation of a Fish Deaiers License for one year.
