CHAPTER 20 - - HISTORIC PRESERVATION
20.1 SECTION 1: DEFINITIONS
20.1.1
A cemetery is defined as "a burial place or a burial ground".
20.1.2
A burial ground is defined as "the site or location whereupon there has been performed the act or process of burying".
20.1.3
An artifact is defined as "(a) a usually simple object (as a tool or ornament) showing human workmanship or modification; (b) a product of civilization; (c) a product of artistic endeavor".
20.1.4
A monument is defined as "a burial vault; a memorial stone or a building erected in remembrance of a person or event".
20.1.5
A ruin is defined as "the remains of something destroyed".
20.1.6
Historic is defined as "of or relating to times or events of written history".
20.1.7
Pre--historic is defined as "of or relating to times before written history".
20.1.8
The definition of antiquity as found in the Federal Antiquities Act is incorporated herein and made a part
hereof by reference.
20.1.9
Indian is defined as "(American Indian) a member of any of the aboriginal peoples of the western hemisphere".
20.2 SECTION 2: PERMIT
20.2.1
Permits for the examination of ruins, burial grounds, cemeteries, the excavation of archaeological sites and the gathering of objects of antiquity upon the lands under the jurisdiction of the Red Cliff Band of Lake Superior Chippewas may be granted by the Red Cliff Tribal Council to institutions or persons which they may deem properly qualified to conduct such examinations, excavation or gathering, subject to such rules and regulations as they may prescribe.
20.3 SECTION 3: PENALTIES
20.3.1
Any person who shall appropriate, excavate, injure or destroy any Indian Cemetery, Indian burial mound or burial ground including burial items as well as skeletal remains, historic or pre--historic ruin or monument, or any object of antiquity situated on lands within the boundaries of the Red Cliff Reservation or within the territory of the Lake Superior Chippewa without the written permission of the Red Cliff Tribal Council having jurisdiction over said lands shall be subject to civil forfeiture of not less than $10.00 nor more than $5000.00 ($50.00 deposit permitted).
