CHAPTER 2 - - DEFINITIONS

2.1

As used in this Code, "Conservation Commission" shall refer to the Red Cliff Conservation Commission, whose nature, powers and duties are set forth in Chapter 3 of this code.

2.2

As used in this Code, "Tribal Council" shall refer to the Red Cliff Tribal Council, as defined in Article III of the Red Cliff Constitution.

2.3

As used in this Code, "Reservation" shall refer to the Red Cliff Reservation as defined in Article I of the Red Cliff Constitution.

2.4

As used in this Code, "Member" or "Member of the Red Cliff Band" shall refer to individuals who qualify for membership under Article II, § 1 or under ordinances adopted pursuant to Article II, § 4 except that where such latter ordinances limit the individuals right to participate in the treaty--protected harvest of natural resources, such language shall be controlling and the individual shall not be deemed a member for purposes of applying this code.

As used in this Code, "non-member" shall refer to any individual, Indian or non-Indian, who does not satisfy the definition of "member" set forth in § 2.4 above.

2.6

As used in this Code, "Enforcement Officer" shall refer to Tribal deputies, Tribal wardens or to deputies of the Bureau of Indian Affairs.

2.7

As used in this Code, "license" and "permit" shall refer to non--transferable entitlements, subject to Tribal regulation of the licensed or permitted activity.

2.8

Except where otherwise indicated, the provisions of this Code are intended to apply to persons both natural and corporate.

2.9

"Violation" shall refer to any violation of a provision of this Code.

2.10

"Violation Notice" shall refer to a brief formal writing, containing matter sufficient to constitute a complaint, which notifies the person cited of a violation and requests that he appear in Court at a specific date and time.

2.11

Other terms, such as "complaint", "summons" and "warrant", shall have the meanings ascribed to them in Chapter IV.

2.12

"Red Cliff Law Enforcement Office" shall refer collectively to Enforcement Officers and their administrative staff.
