CHAPTER 13 - - SNOWMOBILES AND OFF-ROAD VEHICLES
13.1 SECTION 1: GENERAL DEFINITIONS
13.1.1
No non--member shall operate any snowmobile, mini biker, dirt bike or vehicle designed primarily for off road = use, on Indian land without consent of the Tribal Council or Indian owner.
13.1.2
Motorcycles which are not designed primarily for off-road use shall be considered off-road vehicles for the
purposes of this section if they are operated on other than paved roadways or gravel roadways commonly used
for vehicular travel within the confines of the reservation.
13.1.3
Failure to post signs does not imply consent for such use.
13.1.4
As used here "Indian lands" refers to land held in trust by the United States for the use of the Red Cliff Tribe or individual Indians.
13.2 SECTION 2: RESTRICTIONS
13.2.1
Members who have reached the age of 14 may operate the above mentioned vehicles on Indian land limited to the following provisions:
13.2.2
No one shall operate any snowmobile, mini bike, dirt bike or other vehicles designed for off road use on any
road within any Red Cliff housing development for purposes other than entering or leaving the housing development, or at a rate of speed exceeding 10 miles per hour.
13.2.3
The operator of any of the above mentioned vehicles shall slow his/her vehicle to a speed not to exceed 10
miles per hour and yield the right of way when travelling within 100 feet of a person who is not on any of the above mentioned vehicles.
13.2.4
All persons who are under the age of 18 and are operating one of the above mentioned vehicles must wear a protective helmet at all times.
13.2.5
All above mentioned vehicles shall be driven on the side of the road which is with the general flow of vehicular traffic.
13.2.6
All of the above mentioned vehicles being operated during hours of darkness or operated during daylight hours on any roadway shall display a lighted head lamp and tail lamp.
13.2.7
At intersections, the above mentioned vehicles shall stop and yield to all traffic and observe all traffic laws.
13.3 SECTION 3: ROADWAYS
13.3.1
The above mentioned vehicles may be operated adjacent to or on a roadway with due regard to safety in the
following manner:
13.3.2
At a distance of five (5) feet or more from the travelled portion of the roadway, except that all roads within the reservation boundaries excluding Highway 13 shall be open to snowmobiles.
13.3.3
On the roadway to cross a bridge, or culvert but shall yield the right of way to all vehicular traffic.
13.3.4
Directly across any roadway but only after stopping and yielding the right of13.3. way to all vehicles approaching
the roadway.
13.3.5
All above mentioned vehicles travelling adjacent to a roadway shall observe roadway speed limits.
13.3.6
None of the above mentioned vehicles shall be operated on Highway 13.
13.4 SECTION 4: MANNER OF OPERATION
13.4.1
No person shall operate any of the above mentioned vehicles in the following manner:
13.4.2
At a rate of speed that is unreasonable or improper.
13.4.3
In a careless way so as to endanger the person or property of another.
13.4.4
In such a way that the exhaust of the motor makes an excessive or unusual noise.
13.4.5
Between the hours of 10:30 p.m. and 7:00 a.m. when within 150 feet of a dwelling unit at a rate of speed exceeding 10 miles per hour.
13.4.6
With any firearm in his/her possession unless it is unloaded and enclosed in a carrying case or any bow unless it is unstrung or enclosed in a carrying case.
13.5 SECTION 5: PENALTIES
13.5.1
Violation of any provision in this Chapter shall result in a forfeiture of not less than $25.00 nor more than $250.00.
