CHAPTER 11 - - LOGGING, BURNING, AND WOODCUTTING
11.1 SECTION 1: COMMERCIAL LOGGING
No commercial logging operation shall be carried on within the exterior boundaries of the Reservation unless the logger shall hold a logging Permit issued by the Law Enforcement Office.
11.1.1
All such permits shall be subject to such timber cutting regulations as may be promulgated by the Conservation Commission and established as part of this Chapter 11 in order to protect the environment.
11.1.2
Such permits shall not be required where the login is clearly incidental to the clearing of the land for residential, business or agricultural purposes and the site to be logged is no larger than 5 acres, such logging however, is subject to regulations contained in the zoning ordinance.
11.1.3
The fee for a member permit shall be $5.00. The fee for a non-member permit shall be $20.00.
11.1.4
Anyone who violates this chapter 11 shall forfeit not more than $100.00 ($25.00 deposit). Each day of logging shall be considered a separate violation.
11.2 SECTION 2: EMERGENCY ORDERS
11.2.1
When it has reason to believe that a logger is violating regulations promulgated herein and that irreversible environmental damage will result, the Conservation Commission or Tribal Council may order the cessation of logging up to 10 days.
11.2.2
Upon application by the logger or other affected party, the Conservation Commission shall grant a hearing on the emergency order within 48 hours of receipt of the application.
11.2.3
Any logger who violates an emergency an emergency order shall forfeit not more than $100.00 ($25.00 deposit) and shall have his permit revoked.
11.3 SECTION 3: FIRES
11.3.1
Except as otherwise provided in this section, no person shall set any fire within the exterior boundaries of the Reservation without previously securing a burning permit from the Law Enforcement Office. 11.3.1 shall not apply to fires used exclusively for warming the person or cooking food.
11.3.2
No permit or provision of this section shall limit the power of the Tribal Council to order closures of the Reservation or to place an absolute ban on fires.
11.3.3
Anyone who violates 11.3.1 shall forfeit not more than $100.00 ($25.00) deposit permitted.
11.4 SECTION 4: TRIBAL WOODCUTTING FOR HOME USE
11.4.1
No cutting of tribal woods for home use shall be carried on within the exterior boundaries of the Reservation unless a Tribal Wood Cutting Permit has been acquired from the Law Enforcement Office.
11.4.2
Tribal Woodcutting Permits shall be issued by the Law Enforcement Office only to members for home use.
11.4.3
A Tribal Permit shall be issued to only one person per household. A household is defined as all those persons residing in one living unit whether or not they are related by blood or marriage.
11.4.4
Tribal Woodcutting permits shall be subject to such timber cutting regulations as may be promulgated by the Conservation Commission, and made part of this chapter.
11.4.5
The fee for a tribal Woodcutting permit shall be $10.00 per year. Persons over 55 years of age or older shall be issued free permits and shall name any individual who will be cutting wood for them.
11.4.6
No person cutting wood pursuant to a tribal Woodcutting permit shall sell any wood so cut to any person(s) residing off the Reservation nor to non-Indian person(s) residing on the Reservation.
11.4.7
Anyone who violates any provision of this Chapter 11 shall forfeit not more than $250.00.
