CHAPTER 1-6 REVISION OF COLVILLE TRIBAL CODE
1-6-1 Purpose
The Tribal Code of the Confederated Tribes of the Colville Reservation is frequently amended, corrected, revised, updated, and expanded by legislative action of the Colville Business Council. This Chapter is intended to regularize the procedure for adding any and all new language to the Code subsequent to the adoption of any and all new language by action of the Colville Business Council. This regularization will serve to clarify the Tribal Code by making absolutely clear the specific language in the Tribal Code that specific date.
1-6-2 Code Reviser Appointed
The Court Administrator of the Colville Tribal Court is hereby established and appointed Code Reviser for the Confederated Tribes of the Colville Reservation.
1-6-3 Duties of Code Reviser
The Code Reviser shall carry out all duties assigned under this Chapter including but not limited to:
(a) Certify by the signature of the Code Reviser under dated seal, any and all amendments, corrections, revisions, updates, and expansions to and of the Colville Tribal Code enacted by the Colville Business Council; and, where made necessary by the Colville Tribal Constitution or federal law, approved by the Secretary of the Interior; provided, that the Code Revisers' actions shall be ministerial in nature and the Code Reviser shall not be empowered to determine whether or not an action by the Colville Business Council or the Secretary or the Interior is necessary or sufficient for the lawful enactment into law of any amendment, correction, revision, update, or expansion of the Colville Tribal Code.
(b) Keep an official indexed and written record, which shall be public, of all certifications made by the Code Reviser under section 1-6-3(a). Provide copies, free of cost, of all certified amendments, corrections, revisions, updates, and expansions of the Colville Tribal Code, to the following agencies, which are hereby declared depositories for the Colville Tribal Code:
(1) The Colville Tribal Courts.
(2) The Recording Secretary to the Colville Business Council.
(3) The Law Library of the Gonzaga University School of Law.
(4) The Law Library of the University of Washington School of Law.
(5) The Okanogan County Law Library.
(6) The Ferry County Prosecutors' Office.
(c) Provide copies, at cost, of all certified amendments, corrections, revisions, updates, and expansions of the Colville Tribal Code, to any other person or agency requesting such copies.
(d) Certify under oath to the authentic status of the law as set out in the Colville Tribal Code and the specific date upon which any Tribal law went into effect.
1-6-4 Conveyance to Code Reviser
Upon adoption of any and all amendments, corrections, revisions, updates, or expansions of the Colville Tribal Code by the Colville Business Council; or, where necessary, upon approval of such actions by the Secretary of the Interior; the Recording Secretary of the Colville Business Council shall convey a copy of the amendment, correction, revision, update, or expansion of the Code together with a copy of the amendment adopting it, and where necessary, a copy of the Secretarial approval, to the Code Reviser.
1-6-5 Revision of the Code
Upon receipt of all the necessary documents from the Recording Secretary of the Colville Business Council, the Code Reviser shall make a written and dated Certification of Amendment which shall be permanently attached to the said documents and kept in the permanent files of the Code Reviser. Except as otherwise provided by this Section, any and all amendments, corrections, revisions, updates, or expansions of the Code shall be effective on the date of the written Certification required by this Section, and not before. Except in the case of emergencies, no amendments, corrections, revisions, updates, or expansions of the Code shall be effective prior to fourteen (14) days of the date of posting as provided by Business Council rules of procedure.
1-6-6 Depositories
The Code Reviser shall, upon Certification of any and all amendments, corrections, revisions, updates, or expansions of the Tribal Code, convey copies of the Code sections to the depositories designated in Section 1-6-3(b) above.
1-6-7 Distribution
Distribution of new Code sections other than to the depositories designated by this Chapter shall be at the discretion of the Code Reviser and at a cost established by the Code Reviser.
